General terms & conditions

These terms apply to goods ordered via the internet except debenhamsplus.ie. Internet offers relate to internet transactions only and may not be available in store. Likewise, temporary or local special offers in store do not apply to internet prices unless expressly specified.

1. Seller
The Seller is Debenhams Retail (Ireland) Limited, limited liability company, a member of the Debenhams Plc Group of Companies. Registered in Ireland, Companies Registration Office No. 239481 Registered office: 54-62 Henry Street, Dublin 1 Ireland. VAT registration number IE6602192T.

2. Order process
2.1 Our display of products on our website is an invitation and not an offer to sell those goods to you.
2.2 An offer is made when you place the order for your products. Please see Customer Services. For information on how to place an order (this includes a Frequently Asked Questions ) section and as you go through the order process there is also a series of instructions. However, we will not have made a contract with you unless and until we accept your offer (see point 2.5 below).
2.3 We take payment from your card, when we process your order and have checked your card details. Goods are subject to availability. If we are unable to supply the goods, we will inform you of this as soon as possible. A full refund will be given if you have already paid for the goods.
2.4 If you enter a correct e-mail address we will send you an order acknowledgement e-mail and order update e-mail(s). These are not order confirmation or order acceptance from us.
2.5 Unless we have notified you that we do not accept your order or you have cancelled it, order acceptance and the creation of the contract between you and us will take place at the point the goods you have ordered are despatched from our warehouse to be delivered to the address you have given us. It does not take place until that stage, even though we may have debited your card (see 2.3 above) or we have sent acknowledging e-mails (see 2.4 above). Very occasionally an error may occur resulting in the goods described on our website not being the goods actually available for sale. If this occurs your order will not be or have been accepted. We may ask you whether you wish to purchase other goods we may have available or the goods which may have been despatched to you in error. If so your order will be amended. Otherwise, we will treat any order as cancelled and any incorrect goods despatched will be collected for full refund.
2.6 The contract will be formed at the place of despatch of the goods.
2.7 All orders that you place on this website will be subject to acceptance in accordance with clause 2.5 of these terms and conditions.
2.8 We do not file details of your order for you to access please print out these terms and conditions and the order acknowledgement for your own record.

3. Payment
3.1 Payment may be made by the methods indicated on our website. If paying by giftcard, where your giftcard balance is more than the amount of your order, we will deduct the total from your giftcard, and leave any remaining balance on the giftcard.
3.2 You will be charged the current price for buying goods from our website at the date you place your order. All prices are displayed on our website and are inclusive of VAT. We reserve the right to amend prices if there is a change in the rate of VAT (where applicable).
3.3 A delivery charge will be applied at checkout, please view our delivery charges.
3.4 We do our best to make sure that prices are correctly shown but very occasionally an error may occur. If this should happen, we will correct the price and ask you to confirm whether you still wish to purchase the goods at the correct price. If we are unable to contact you, we will treat the order as cancelled. We will not accept an order if there is a pricing error.

4. Delivery
4.1 We deliver to any Republic of Ireland address, please view our delivery information for further information.
4.2 Orders generally require a signature to acknowledge delivery. The signature of the person accepting delivery at the delivery address will be proof that delivery has been received by you or the person, to whom the order is addressed. If no one is available to accept the delivery you will receive a card to advise that a delivery has been attempted.

5. General
5.1 Certain products are subject to age restrictions as indicated on the product page. By placing your order for any of these products, you confirm that you have reached the required age. Your entire order will be cancelled if we are unable able to verify your age using the details you have submitted. Alcohol can only be purchased by and for individuals aged 18 or over and liqueur chocolates can only be purchased by or for individuals aged 16 or over.
5.2 All measurements are approximate.
5.3 The reproduction of colours is as accurate as the photographic and production process will allow.
5.4 All matters concerning and incidental to any offer or agreement for the purchase and sale of goods from our website shall be in English and construed and governed according to the laws of the Republic of Ireland and the Irish courts shall have jurisdiction in all such matters.

6. Cancellation
If, for any reason, you wish to do so you have the right to cancel any order you have placed (other than in respect of goods made to your specification, clearly personalised or unsealed audio or video recording or computer software). Where the goods have been delivered to you, you may cancel them up to 7 working days, starting from the day after the goods were received, in line with the European Communities (Protection of Consumers in Respect of Contracts Made by Means of Distance Communication) Regulations 2001. Any delivery charges will be refunded, however, if only part of your order is cancelled, the delivery charge will not be refunded.

The following procedures will apply:
6.1 You can either email directcustomerservices@debenhams.com or telephone our Online Customer Services Team on 0818 784 877. If you have contacted us to cancel before delivery of your goods, though your order will have been cancelled, normally delivery cannot be interrupted (except possibly if cancellation takes place within 30 minutes of order). Please refuse any delivery of cancelled goods or return them to us. Most goods can be returned to a local Debenhams store or by post, in the meantime you must take reasonable care of them.
6.2 For instructions on how to return an order, please view our Returns and Refunds section. You will not be charged for Postal Returns in accordance with our returns process.

7. Returns
7.1 In addition to your cancellation rights as described in point 6, we have a 'Goodwill' policy, for further details please refer to our Returns & Refunds section.
7.2 Throughout the Christmas period online purchases come with a temporary extension to the returns deadline - now up to 28th January 2013 - applicable to anything bought up to the last order date.

8. Clearance section
The reductions shown are reductions from the original price charged on the website. Occasionally these prices may have applied more than three months ago.

9. WEEE (Waste Electrical and Electronic Equipment)
9.1 From 13th August 2005, all retailers of electrical goods must comply with the Waste Electrical and Electronic Equipment (WEEE) legislation. This is a scheme to prevent all such waste being disposed of in general landfill sites and to promote recycling of components and materials. The legislation aims to minimise the impact of electrical and electronic equipment on the environment by creating products with recycling in mind and encouraging reuse, recycling, and recovery of WEEE.
9.2 The definition of a WEEE product is one whose primary function is dependant on electrical currents to carry out the main function, e.g., a toaster. However, some products, such as a child's soft toy with an electric circuit, is not classed as WEEE as its primary function is a toy.
9.3 A producer recycling fund contribution has been applied to the retail price of new electrical and electronic goods. The prices of these items include contributions to a producer recycling fund to ensure that WEEE is collected and recycled in a responsible manner. Producer recycling fund contributions have been set and agreed by the WEEE Register, an independent regulation body authorised by the Minster for the Environment, according to specific product types and these costs are the same regardless of what brand or from what outlet in the Republic of Ireland an item is purchased.
9.4 WEEE and waste batteries must never be placed in your waste disposal or recycling bins. WEEE is taken back free of charge at electrical retail outlets on a one-for one like-for-like basis. There is a bin for small batteries in your local Debenhams store. Local authority civic amenity facilities also take back WEEE and waste batteries free of charge. WEEE and waste battery recycling is free.
9.5 A take-back service operates either in Debenhams Stores or from home (provided that the WEEE has been disconnected from public utilities or permanent structure and is ready for immediate collection), depending on whether you purchase in store or online. If we deliver to your home we will aim to provide 24 hours notice of the delivery so you can ensure that your old WEEE is ready for collection. If we are unable to provide you with 24 hours notice we will return within 15 days (on 24 hours notice) to collect your old WEEE. When you purchase a new electrical item from Debenhams you can exchange an old similar item for recycling (e.g. a toaster for a toaster, or a similar small domestic appliance such as a kettle.
9.6 In order to do this in store, you must take your new purchase receipt to your local Debenhams store in order to prove that the old item you are bringing back has a new similar purchase to link to.
9.7 You have 28 days from the date of purchase to bring the old item to your local Debenhams store. This period is lengthened to 48 days for debenhams.ie customers.

Furniture terms & conditions

These terms apply to items ordered via the Internet except debenhamsplus.ie, Debenhams mobile phone app and over the phone ("Distance Sales") for furniture products including divan beds, bedframes, mattresses, garden furniture and barbecues. Internet offers relate to Internet transactions only and may not be available in store. Likewise, temporary or local special offers in store do not apply to Internet prices unless expressly specified.

3. Payment
3.1 Payment may be made by the methods indicated on our website. If paying by giftcard, where your giftcard balance is more than the amount of your order, we will deduct the total from your giftcard, and leave any remaining balance on the giftcard.
3.2 All total prices for goods and services at the checkout represent the total price payable by the customer for those items, regardless of the address for delivery within the Republic of Ireland ("ROI"). This price includes VAT (or VAT equivalent) at the current rate. We reserve the right to amend prices if there is a change in the rate of VAT (where applicable). Other components of the total price at the checkout, including delivery charge, may vary for each customer.

4. Delivery
4.1 When your order is ready to be delivered the delivery team will contact you to confirm a date for delivery to the address specified within the ROI. No deliveries will be made outside the ROI. You should expect to hear from the furniture team two or three weeks before the estimated delivery.
4.2 Deliveries are normally booked at least 7 days in advance; if you need to change a delivery booking for whatever reason then this must be done with at least 48 hours notice or a 36.50 Euro charge will be incurred to cover the cost of the cancellation.
4.3 It is your responsibility to ensure that the products ordered can be delivered and will fit into the property and that any entranceways, hallways, corridors etc are wide enough for the products to pass through and will fit in the required location. In particular there should be space for the delivery vehicle to make the delivery. If, in the reasonable opinion of our delivery team, a delivery cannot be made to a specified location due to the nature of the premises, insufficient access or for any reason not attributable to us including your absence, you will be liable for the delivery cancellation charge stated in point 4.2 above.
4.4 We shall have no liability to you in respect of any delay or failure to deliver a product due to circumstances beyond our reasonable control, including (without limitation) delay or failure caused by adverse weather, strikes or transport problems.
4.5 You are responsible for checking the condition of the products delivered and must highlight any issues with the delivery team. Should there be any issues the delivery team will direct all queries at this stage to the manufacturer who will agree a means of resolving the issues that are presented at this time. If you are not happy with the response from the manufacturer please contact our Online Customer Services Team on 0818 784 877.

4.8 Free delivery applies to orders of €30 and over placed online at debenhams.ie to the ROI. Delivery is normally charged at €5 per delivery address irrespective of the number or type of items. We deliver to any ROI address on the mainland, but please call our Online Customer Services Team on 0818 784 877 to enquire about whether we are able to deliver to islands off the mainland. 5. Cancellation
5.1 Under the European Communities (Protection of Consumers in Respect of Contracts Made by Means of Distance Communication) Regulations 2001, which apply to orders made by means of a distance communication, you have the right to cancel your order and receive a refund up to 7 working days after receipt of the products. This shall not apply to any products that are made to your specification or which are clearly personalised. The products must be kept in reasonable condition and made available for collection. A 109.50 Euro charge will be made for the cost of collection of furniture products except for outdoor furniture, barbecues & chimeneas, rugs, bean bags, headboards, bedframes, office chairs and desks, lighting, TV stands, Hi Fi stands, dining and bedroom mirrors in which case the cost of collection will be 36.50 Euro.

6. General
6.1 All measurements displayed on our website or otherwise are approximate.
6.2 The reproduction of colours is as accurate as the photographic and production process will allow.
6.3 The reductions shown in clearance sections are reductions from the original price charged on the website and the products in question shall have previously been offered for sale at this original price for a reasonable period of time . 6.4 All risk in the products we supply to you, in particular the risk of any loss or damage, shall pass to you on delivery of the products to the address you specify in your order. Ownership of the products shall not pass to you until we have received payment in full in respect of such products.
6.5 We shall not be liable for any indirect losses you may suffer, including any loss of profit, income or anticipated savings as a result of our failure to comply with these terms or our negligence. Save that our liability in respect of any death or personal injury caused by our negligence or any other matter which may not be excluded by law shall not in any way be restricted.
6.6 These terms, constitute the entire terms on which we will provide products to you and cancel and supersedes all prior arrangements and representations, whether verbal or written.
6.7 We may amend these terms from time to time at our discretion without notice to you. Any amends will be posted on this website and will supersede any terms and conditions previously published by us.
6.8 No delay or failure by ourselves in exercising or enforcing any of our rights or remedies under these terms shall operate as a waiver of those rights.
6.9 If any one or more of the provisions of these terms should be held by any court to be unenforceable, such provision shall be validly restated to as nearly as possible approximate the intent of the clause and, if such clause cannot be restated for any reason, shall be severable from these terms and deleted.
6.10 You may not assign or sub-contract any of your rights or obligations under these terms to any person without our prior written consent. No third party shall be entitled to enforce any of these terms or otherwise.
6.11 All matters concerning and incidental to any offer or agreement for the purchase and sale of products from our website shall be in English and construed and governed according to the laws of the Republic of Ireland and the Irish courts shall have jurisdiction in all such matters.

Debenhams e-Giftcards

1. Euro currency e-Giftcards can be used as full or part payment for merchandise in Debenhams department stores within the Republic of Ireland (ROI) and online at debenhams.ie.
2. e-Giftcards may not be exchanged for cash or vouchers, used as a deposit on a credit agreement, used to settle a Debenhams Account Card or to purchase financial or travel services.
3. The minimum amount required to top-up an e-Giftcard online at debenhams.ie is €1. The maximum balance limit is €2,000.
4. No change or refund will be given when an e-Giftcard is redeemed but any remaining balance may be applied to future purchases.
5. The balance of an e-Giftcard can be checked in store or online at debenhams.ie.
6. e-Giftcards expire 24 months after the last use or balance enquiry and any remaining balance will be deducted.
7. Debenhams reserves the right to reject an e-Giftcard that is illegible or incomplete or where, in its sole discretion, it has reason to believe it is not genuine.
8. e-Giftcard numbers/codes and PINs remain the property of Debenhams (including all intellectual property in the source code).
9. Debenhams is not liable for any lost, stolen, damaged, undeliverable, incorrectly addressed or delayed e-Giftcards or any network failures. Nor is Debenhams responsible for any e-Giftcard that is used by someone other than the intended recipient after delivery.
10. It is the responsibility of the purchaser to ensure that any text message, voice message and/or image attached to an e-Giftcard will not cause offence to a recipient, or any person who the purchaser could reasonably have foreseen as potentially reading, seeing or hearing it, and that all subject matter can be legally read, seen or heard in the country or territory where the recipient can reasonably be expected to access it.
11. Debenhams will not apply any message or data rate charges for sending e-Giftcards or notification texts to mobile devices. However, Debenhams cannot be held liable for any message or data rate charges that may be applied by network operators for receiving e-Giftcards or notification texts on mobile devices.
12. Debenhams reserves the right to amend these terms and conditions from time to time where it reasonably considers it necessary to do so (e.g. to change the scope of the e-Giftcard service, notify of the service's withdrawal or in the event of circumstances beyond its control). Reasonable notice of such changes will be given where possible.
13. There is no right to cancel an e-Giftcard purchase once the e-Giftcard has been spent in full or in part.
14. By purchasing and / or redeeming an e-Giftcard you accept and agree to these terms and conditions.

Debenhams Giftcard terms & conditions

1. Validly activated gift cards are redeemable in full or part payment for merchandise from Debenhams Stores within the Republic of Ireland or online at debenhams.ie. They cannot be redeemed in the UK or at debenhams.com.
2. Debenhams gift cards may not be exchanged for cash or vouchers, used as a deposit on a credit agreement or to purchase financial or travel services.
3. Debenhams gift cards cannot be used on the following Debenhams Partnerships websites: debenhamsplus.ie.
4. The minimum amount required to top-up a Debenhams gift card is €1. The maximum gift card limit is €3,000.
